Terms and Conditions
1. Rules and Regulations
That I will comply with CL University Mandarin (hereinafter referred to as CLUM) and the host institutes' rules and regulations whilst I am a participant of CLUM's Program during the period enrolled.
2. Standards of Conduct
That CLUM or the host institute shall have the right to enforce appropriate standards of conduct and that it may at any time terminate my participation in its program for failure to maintain these standards or for any actions or conduct which CLUM or host institute considers to be incompatible with the interest, harmony, comfort and welfare of other students.
3. Termination
i) That if my participation is terminated, I consent to being sent home on my own (or my parents) expense with no refund of fees.
ii) That if I leave the program voluntarily for any reason, there will be no refund of fees already paid.
4. Refunds
i) That written notification is required to be given and received by CLUMs United States Office providing reasons for cancellation of the program and request for a refund.
ii) That 100% of the program fees shall be refunded (excluding application fee) when notice is given more than 28 days before the start of the program. That 80% of the program fees shall be refunded (excluding application fee) when notice is given 22 to 28 days before the start of the program, that 70% of the program fee (excluding application fee) shall be refunded when notice is given 15 to 21 days before the program has started and that 60% of the program fee (excluding application fee) shall be refunded when notice is given less than 14 days before the program has started due to the many expenses involved in arranging a program and the various policies of schools and housing. Please note that CLUM makes financial commitments on behalf of its participants well in advance of the start date.
iii) That once the program has commenced there shall be no refund of program fees. In case of emergency or for medical reasons claims should be directed to the approved Insurance Provider.
iv) A Combination Program is comprised of two or more separate programs 'combined' as one program and where only one application fee is applied. Once a Combination Program has commenced it shall be regarded under the same terms as a single program.
v) That any bank or transfer fees associated with the refund of the program fees shall not be the responsibility of CLUM.
vi) An Academic Year program that consists of two or more terms/semesters is regarded as a single program. Once an Academic Year program has commenced there shall be no refund of program fees. In case of emergency or for medical reasons claims should be directed to the approved insurance provider.
5. Cancellation and Changes
i) That in any activities or tours arranged by CLUM or the host institute I will accept the will of the majority whenever a matter of choice is presented to the group.
ii) I accept that CLUM or the host institute reserves the right to make any cancellations, changes or substitutions in cases of emergency or changed conditions or in the interest of each group.
6. Visa
i) I understand and accept that it is my responsibility to obtain all visas and required documents and in the event I cannot obtain the necessary documents for participation I shall not hold CLUM responsible.
ii) That in the event that my visa application is rejected, I will be entitled to 100% refund of the program fees (excluding the application fee).
7. Waiver
i) I hereby waive and release all claims against CLUM and its agents, including any person or entity employed or utilized by CLUM and host institutions for any control, including (without limitation) acts of God, war, strikes, incidents of politically-motivated violence, sickness or quarantine, government restrictions or regulations or in the absence of its own negligence, arising from the use of any university, institute, vehicle railroad, bus company, taxi service, hotel, restaurant, or other firm, agency, company or individual.
ii) I understand that I am responsible for exercising caution and common sense at all times to avoid injuries.
iii) I hereby waive and release all claims against CLUM and its agents arising during the program and at a time when I am not under the direct supervision of CLUM or its agents or arising out of my failure to remain under such supervision or to comply with such rules, standards and instructions, and I agree to indemnify CLUM and its agents against any consequences thereof.
8. Insurance
i) I understand travel accident and sickness insurance coverage for my benefit is optional and offered by approved insurance provider, and that the purchase of such insurance coverage is included in the program fees.
ii) I understand that the insurance is between myself and approved insurance provider and that CLUM is not a party to the contract.
iii) I accept that any claims to be made to approved insurance provider will be done directly to the insurance company without the involvement of CLUM.
iv) CLUM is not responsible for any injury or loss whatever suffered by me during periods of the program and during independent travel (which I understand are unsupervised) or during any absence from the university or other CLUM - supervised activities.
v) I expressly acknowledge and agree as a condition of traveling on a CLUM program that I (and anyone claiming through me) shall have no rights whatsoever, directly or indirectly, under and theory at law or in equity against CLUM.
vi) I hereby grant CLUM and its agents full authority to take whatever actions they may consider to be warranted due to any international or political unrest, personal emergency or other event regarding my health and safety, and I fully release each of them from any liability for such decisions or actions as may be taken in connection therewith.
vii) I authorize CLUM and its agents at their discretion to place me at my own (or my parents) expense and without my further consent in a hospital for medical services and treatment, or if no hospital is readily available, to place me in the hands of a local medical doctor for treatment.
9. Loan
If deemed necessary or desirable by CLUM or its agents advance or loan any monies to me or incur special expense on my behalf while I am abroad, I (and my parents) agree to make immediate repayment upon my return.
10. References
All references herein to "CLUM" apply to its officers, directors, staff members, campus directors, chaperons, group leaders, teachers, host institute or institute officials, employees, agents and affiliated companies.
11. Modifications
That these terms and conditions are standard and cannot be modified or interpreted except in writing and that no oral modification or interpretation shall have any validity.
